1. Agreement to these terms
These Terms of Service (the “Terms”) govern your access to and use of this website (the “Site”), which is owned and operated by Trusted Appliance Repair (“we,” “us,” or “our”). By using the Site, or by sending an inquiry or calling a number shown on it, you agree to these Terms and to our Privacy Policy. If you do not agree with them, please do not use the Site.
2. What this Site is, and what it is not
The Site is an independent marketing website. We run it to connect homeowners who need appliance repair services with an independent local business (the “Service Provider”).
You acknowledge and agree that:
- We are not the Service Provider. We do not perform, supervise, or guarantee any appliance repair work. All services are carried out by the independent Service Provider, not by us.
- We are not a party to your agreement with the Service Provider. Any quote, contract, payment, service, warranty, or dispute is strictly a matter between you and the Service Provider.
- We do not endorse or guarantee the Service Provider. We do not verify, endorse, or accept responsibility for the licensing, insurance, qualifications, pricing, conduct, timeliness, or workmanship of any Service Provider. It is up to you to satisfy yourself that a Service Provider is suitable and properly licensed and insured before you hire them.
- Service claims are the Service Provider’s. Statements on the Site about workmanship guarantees, warranties, response times such as same-day availability, and pricing practices are claims of the Service Provider. The Service Provider makes them, honours them, and is responsible for them. We do not make, adopt, or stand behind those claims.
- Content is for general information only. Descriptions of services, coverage areas, credentials, and availability on the Site serve general marketing purposes, may be supplied by or on behalf of the Service Provider, and may not be complete or current.
A note on “we” elsewhere on the Site. The Site is written in the first person because it presents the Service Provider’s business to you. On the service, location, and about pages, words like “we,” “us,” and “our” refer to the Service Provider who carries out the work. In these Terms and in the Privacy Policy, those same words refer to the owner and operator of the Site.
3. No professional advice; no guaranteed results
Information on the Site is general in nature and is not professional advice. Please do not treat it as a substitute for advice from a qualified professional. We make no guarantee that using the Site will produce any particular service, price, response time, or outcome.
4. Calls and call recording
Phone numbers shown on the Site connect through our call system and are forwarded to the Service Provider. Calls may be recorded for quality-assurance and training purposes. You will be told that a call may be recorded, and carrying on with the call means you consent to the recording. If you would rather not be recorded, you can use the contact form or ask to be contacted by email instead. Our Privacy Policy explains how call recordings and inquiry information are handled.
5. Submitting information through the Site
When you send an inquiry, you agree that the information you provide is accurate and that we may share it with the Service Provider so they can respond to you, as our Privacy Policy describes. Please do not submit anyone else’s personal information without their permission, and leave sensitive information out of your message.
6. Acceptable use
You agree not to use the Site to:
- break any law or infringe anyone’s rights;
- submit false, misleading, or fraudulent information;
- interfere with, disrupt, or try to gain unauthorized access to the Site or its systems;
- copy, scrape, harvest, or systematically collect content or data from the Site without our written permission; or
- transmit any virus, malware, or other harmful code.
7. Intellectual property
The Site and its content, including text, graphics, logos, layout, and design, belong to us or to our licensors and are protected by intellectual-property laws. You may view and use the Site for your own personal, non-commercial purpose of finding and contacting a Service Provider. Beyond that, you may not reproduce, distribute, or create derivative works from the Site without our written permission.
8. Third-party links
The Site may link to third-party websites or resources. Those links are offered for convenience only, and we are not responsible for the content, products, or practices of any third-party site. You access them at your own risk.
9. Disclaimer of warranties
The Site and all of its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, nor that any information on it is accurate or current. Some jurisdictions do not permit the exclusion of certain warranties, so parts of this exclusion may not apply to you.
10. Limitation of liability
To the fullest extent the law permits, Trusted Appliance Repair and its owners, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, business, or goodwill, arising out of or relating to your use of the Site or your dealings with any Service Provider, whether the claim is based in contract, tort, or otherwise, and even if we were advised that such damages were possible. Because we are not a party to your agreement with the Service Provider, we are not responsible for any act, omission, service, or damage caused by a Service Provider. If we are nonetheless found liable, our total liability for any claim relating to the Site is limited to CAD $100. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify and hold harmless Trusted Appliance Repair and its owners, officers, and employees from any claims, losses, liabilities, and expenses, reasonable legal fees included, arising out of your use of the Site, your breach of these Terms, or your dealings or dispute with any Service Provider.
12. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share personal information, call recordings included.
13. Governing law
These Terms are governed by the laws of the Province of Ontario and by the federal laws of Canada that apply there, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Ontario for any dispute relating to the Site or these Terms, subject to any mandatory consumer-protection rights you hold in your own province.
14. Changes to these terms
These Terms may be updated from time to time. When they are, we will change the “Last updated” date at the top. Significant changes will be noted on the Site. Continuing to use the Site after a change means you accept the revised Terms.
15. Severability and entire agreement
If any provision of these Terms turns out to be unenforceable, the rest stay in full effect. These Terms, together with the Privacy Policy, form the entire agreement between you and us regarding the Site.
